About FairwayOps

FairwayOps is a workforce scheduling and operations platform operated by BMODified, LLC. By accessing or using FairwayOps, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.

Acceptable Use

FairwayOps is provided exclusively for legitimate workforce scheduling and operational communication purposes within your organization. You agree to use the platform only for its intended purpose and in compliance with all applicable laws and regulations.

You agree not to:

• Use the platform for any unlawful, fraudulent, or harmful purpose
• Attempt to gain unauthorized access to any accounts, systems, or data
• Transmit spam, unsolicited messages, or abusive content
• Interfere with or disrupt platform operations or servers
• Reverse engineer, copy, or redistribute any part of the platform
• Share your account credentials with unauthorized individuals

Account Responsibilities

Access to FairwayOps is by invitation only through your organization's administrator. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify your administrator immediately if you suspect unauthorized access to your account.

SMS Communications

By opting in to SMS notifications within FairwayOps, you consent to receive text messages related to your work schedule, shift assignments, and operational alerts. Message and data rates may apply. You may opt out at any time by replying STOP to any SMS message or by updating your notification preferences in the app.

Service Availability

BMODified, LLC will make reasonable efforts to maintain platform availability but does not guarantee uninterrupted or error-free service. We reserve the right to modify, suspend, or discontinue any feature or the platform itself at any time, with or without notice. Scheduled maintenance windows may result in temporary unavailability.

Intellectual Property

All content, features, and functionality of FairwayOps — including software, design, logos, and text — are the property of BMODified, LLC and are protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the platform without express written permission.

Disclaimer of Warranties

FairwayOps is provided “as is” and “as available” without warranties of any kind, either express or implied. BMODified, LLC does not warrant that the platform will be error-free, uninterrupted, secure, or free of viruses or other harmful components. Your use of the platform is at your sole risk.

Limitation of Liability

To the fullest extent permitted by applicable law, BMODified, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the FairwayOps platform, even if BMODified, LLC has been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to these Terms or the platform shall not exceed the amount you paid to BMODified, LLC in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless BMODified, LLC and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the platform or your violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions.

Changes to These Terms

BMODified, LLC reserves the right to update these Terms at any time. Continued use of the platform after changes are posted constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify users of significant changes.
